MY PRACTICE AREAS

CAR ACCIDENTS
One of the reasons to hire an attorney to represent you in a car accident case is to let your attorney worry about getting you the compensation you deserve so you can focus on your recovery. Depending on the severity of your injury, you may be laid up for months or even years. Car accident injuries sometimes lead to chronic pain and disability. If you accept whatever an insurance company offers for your losses, you may not have enough money to pay your bills.
TRUCK ACCIDENTS

Many trucking accidents are caused by the deliberate violation of municipal, state, and federal safety regulations. Among these regulations is the requirement that truck drivers must take periodic rest breaks to prevent driver fatigue. Trucking companies are required to hire qualified drivers and conduct periodic tests for use of illegal drugs. Mr. Akins is familiar with trucking regulations that apply to trucks in South Carolina and Georgia, and he will take immediate steps to secure the documents that are needed to prove any violations of safety regulations that occured.

WRONGFUL DEATH

Every wrongful death case is different, and may require a different approach on the part of your lawyer. Aggressive representation is needed to hold the responsible party accountable.

DROWNING ACCIDENTS

Drowning accidents often involve negligence by a pool owner. In one of the cases Mr. Akins handled, a child drowned because he gained access to a pool through a defective gate that had been there for many years. In cases like this, the civil justice system must hold property owners responsible.

MEDICAL ERRORS

A bad medical result in itself does not mean that anyone did anything wrong. A serious injury or even death can occur despite the best efforts of doctors and hospital staff. However, if the medical provider failed to follow the accepted standard of care and you were injured as a result, you may be entitled to compensation.

PREMISES LIABILITY

Many people believe that if you simply fall down in a store, you have a case that is worth money. That is not true. To have a viable case, your lawyer has to be able to show that the store owner created a hazardous condition, or allowed one he or she knew about to remain uncorrected. For example, if you slipped over a spilled liquid in a grocery store, you may not have a case unless a store employee knew about the spill and did nothing to clean it up or to warn shoppers.

PRODUCT LIABILITIY

When a company is making a profit off a product that is injuring consumers due to a defective design or the lack of proper warnings, sometimes the only way to keep the unsafe product off the market and to protect families is to sue the company.

INSURANCE BAD FAITH

Many insurance companies systematically deny claims simply because it’s profitable to do so. When an insurance company fails to investigate your claim, denies benefits without a good reason, or forces you to jump through unnecessary “hoops” to get the coverage you paid for, the insurance company may be guilty of bad faith.

DISCRIMINATION

One of the most common types of discrimination in the workplace today is age discrimination. It arises from employers seeking to replace men and women in their 40s and 50s with employees who are younger and cheaper. Often, this happens on a systematic basis within a company. Some of the warning signs include “false” bad performance reviews for older workers and age-related comments from supervisors.

WRONGFUL TERMINATION
Many wrongful termination cases are discrimination cases at their core. It is illegal under state and federal laws to fire or otherwise discriminate against an employee on the basis of age, race, disability gender, sex, national origin or religion. In these cases, it is not the termination that is illegal but the underlying reason for it.
MEDIATION
Mr. Akins has been certified as a mediator by the South Carolina Supreme Court, and approved by the United States District Court for the District of South Carolina. Mr. Akins offers his services as a mediator to all interested parties.
